These are the standard terms and conditions which apply to all purchases of eBooks made through BookStreet.io. The contract for each eBook is between you (the customer) and the seller identified below.

01

About the seller

The seller of each eBook is the author, publisher or rights-holder who has listed that eBook on BookStreet.io. By listing an eBook on BookStreet.io, the seller agrees to sell on these standard terms.

BookStreet.io acts as the seller’s agent for the purposes of communicating offers, forming the contract and processing payment. All enquiries and complaints should be directed to the Author in the first instance.

02

Key terms

When you buy an eBook through BookStreet.io, you are agreeing that:

  • Your contract is directly with the seller, not with BookStreet.io.
  • The seller only accepts orders when they have been checked and confirmed.
  • Orders are fulfilled automatically, but BookStreet.io may cancel orders in exceptional circumstances.
  • Payment is taken at the point your order is accepted.
  • As a digital content product, your eBook will be delivered electronically - there is no physical delivery.
  • You have a legal right to change your mind within 14 days, but you lose this right once you access or begin downloading the eBook.
  • You have rights if there is something wrong with the product.
  • The seller’s liability to you is limited in certain respects.
  • Your personal data will be used in accordance with BookStreet.io’s Privacy Notice.
  • You have several options for resolving disputes.
03

How the contract is formed

When you place an order for an eBook through BookStreet.io, you are making an offer to buy from the seller. BookStreet.io will send you an order acknowledgement on the seller’s behalf confirming receipt of your order. This acknowledgement does not mean your order has been accepted.

A binding contract between you and the seller is formed when BookStreet.io sends you an order acceptance email on the seller’s behalf. BookStreet.io acts as a disclosed agent of the seller for the purposes of forming this contract and processing payment. BookStreet.io is not a party to the contract and does not sell eBooks to you.

04

Automatic fulfilment and exceptional cancellations

Once you place an order and payment is confirmed, the order will be fulfilled automatically and the eBook will be delivered to you digitally. In exceptional circumstances (for example, where an eBook is removed from the platform, or where a payment is subsequently found to be fraudulent), BookStreet.io may need to cancel an order, in which case any payment taken will be refunded promptly.

05

Age-restricted eBooks

Certain eBooks on BookStreet.io are categorised as containing age-restricted content, meaning they contain sexually explicit material or other content which is unsuitable for persons under the age of 18. These eBooks are clearly identified on the platform.

You may not purchase or access any age-restricted eBook unless you have successfully completed BookStreet.io’s age verification process and been confirmed as aged 18 or over. Details of the age verification process, including the types of identification accepted, are set out in our Website Terms of Use.

If you place an order for an age-restricted eBook without having completed age verification, or if your age verification is subsequently found to be invalid, BookStreet.io may cancel the order and revoke access to the eBook. Any refund due in these circumstances will be processed in accordance with these terms.

06

Payment

Payment for your eBook is taken at the point the order is accepted. All payments are processed through BookStreet.io’s third-party payment provider on behalf of the seller. BookStreet.io does not hold your payment details.

Prices are displayed in local currencies where possible and are inclusive of VAT where applicable. If the rate of VAT changes between the date of your order and the date of supply, the seller will adjust the VAT rate accordingly, unless payment has already been taken in full before the change takes effect.

If we’re unable to collect any payment you owe, interest may be charged on the overdue amount at the rate of 4% a year above the Bank of England base rate from time to time. This interest accrues on a daily basis from the due date until the date of actual payment of the overdue amount, whether before or after judgment. You pay us the interest together with any overdue amount.

The Seller is not responsible for delays outside of our control

If our supply of your product is delayed by an event outside our control, we contact you as soon as possible to let you know and do what we can to reduce the delay. As long as we do this, we won't compensate you for the delay, but you can contact the Seller or BookStreet.io to end the contract and receive a refund for any products you have paid for in advance, but not received.

Delivery of your eBook

Your eBook is a digital product. Once your order has been accepted, the eBook will be made available to you for download through your BookStreet.io account and, where applicable, delivered to you by email. There is no physical delivery.

The seller aims to make eBooks available immediately upon acceptance of your order. If there is a delay due to circumstances outside the seller’s reasonable control, BookStreet.io will notify you on the seller’s behalf. If the delay is substantial, you may contact BookStreet.io’s customer service to cancel your order and receive a full refund for any eBooks paid for but not received.

We can suspend the supply of a particular eBook.

We do this to deal with technical problems, make changes, to reflect changes in laws or regulatory requirements or, because an eBook is found to breach BookStreet.io Prohibited Content Policy.

If we do this, we may block delivery of the eBook and/or remove its listing.

If you have ordered an eBook which is not delivered, we will refund you in full.

07

Your right to change your mind (cancellation rights)

eBooks are digital content for the purposes of the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

You have a legal right to change your mind and cancel your order within 14 days of the date on which the order acceptance is sent to you, without giving any reason.

Important: You will lose your right to cancel once you access or download the eBook. Before the eBook is made available for download, you will be asked to give your express consent to the supply of digital content and to acknowledge that you will lose your right to cancel once supply begins. By giving this consent and accessing or downloading the eBook, you agree that you lose your cancellation right.

If you wish to cancel before you have accessed or downloaded the eBook, you can do so by contacting BookStreet.io’s customer service. Any refund due will be processed as soon as possible and in any event within 14 days of your cancellation, using the same payment method as the original transaction. No cancellation fee will be charged.

08

Your rights if there is something wrong with the eBook

The seller is under a legal duty to supply eBooks that are in conformity with the contract. If you think there is something wrong with your eBook (for example, the file is corrupted, incomplete, or does not match the description), you should contact BookStreet.io’s customer service.

Your legal rights under the Consumer Rights Act 2015 include the right to a repair or replacement of digital content that does not conform to the contract, and if this is not possible or not done within a reasonable time and without significant inconvenience, the right to a price reduction. These rights are subject to certain exceptions. For detailed information, please visit the Citizens Advice website at www.citizensadvice.org.uk

Summary of your key legal rights

The Consumer Rights Act 2015 says digital content must be as described, fit for purpose and of satisfactory quality:

  • If your digital content is faulty, you're entitled to a repair or a replacement.
  • If the fault can't be fixed, or if it hasn't been fixed within a reasonable time and without significant inconvenience, you can get some or all of your money back.
  • If you can show the fault has damaged your device and we haven't used reasonable care and skill, you may be entitled to a repair or compensation.

Nothing in these terms affects your statutory rights.

09

Licence and intellectual property

When you purchase an eBook, you are granted a non-exclusive, non-transferable, personal licence to access and read the eBook for your own private, non-commercial use. You do not acquire ownership of the intellectual property in the eBook.

You must not:

  • Copy, reproduce, distribute, republish, sell, resell, lend, or sublicense the eBook or any part of it.
  • Remove, alter or obscure any copyright notice, digital rights management technology, or other proprietary notice contained in the eBook.
  • Use the eBook for any commercial purpose.
  • Attempt to reverse-engineer, decompile or extract the source code or underlying data of the eBook file.

The seller retains all intellectual property rights in the eBook, including copyright. Any breach of these licence terms may result in the termination of your licence and may expose you to legal action.

10

Changes to eBooks and these terms

The seller may make minor updates to an eBook after purchase (for example, to correct typographical errors or address security issues). Such changes will not materially affect the eBook or your use of it.

These standard terms may be updated from time to time. The version in force at the date of your purchase will apply to that purchase.

11

Limitation of liability

Nothing in these terms excludes or limits the seller's liability for death or personal injury caused by the seller's negligence, fraud or fraudulent misrepresentation, or any liability which cannot lawfully be excluded or limited.

We're not responsible for losses you suffer caused by us breaking this contract if the loss is:

  • Unexpected. It was not obvious that it would happen and nothing you said to us before we accepted your order meant we should have expected it (so, in the law, the loss was unforeseeable).
  • Caused by a delaying event outside our control. As long as we have taken the steps set out in the section we're not responsible for delays outside our control.
  • Avoidable. Something you could have avoided by taking reasonable action. For example, damage to your own digital content or device, which was caused by digital content we supplied and which you could have avoided by following our advice to apply a free update or by correctly following the installation instructions or having the minimum system requirements advised by us.

To the extent that you use a product for the purposes of your trade, business, craft or profession then, save in respect of any liability which cannot legally be limited, our total liability to you for all losses arising under or in connection with any contract between us, whether in contract, tort (including negligence), breach of statutory duty, or otherwise, shall be limited to what you paid for the product and all claims for loss of profit or indirect or consequential loss are wholly excluded.

The seller's total liability to you in connection with any eBook purchase shall not exceed the price paid by you for that eBook.

12

BookStreet.io’s role

BookStreet.io is an online marketplace operated by Autaway Limited. BookStreet.io provides the platform through which you browse, purchase and download eBooks. BookStreet.io acts as a disclosed agent of the seller in forming the contract and processing payment. BookStreet.io does not sell eBooks to you and is not a party to the contract between you and the seller.

BookStreet.io's separate Website Terms of Use govern your use of the BookStreet.io website and platform. Those terms are available at Website Terms of Use.

13

Personal data

The seller and BookStreet.io will use your personal data in accordance with BookStreet.io's Privacy Notice, available at Privacy Policy. Privacy Policy. Your personal data will be shared with the seller to the extent necessary to fulfil your order and deal with any queries, complaints or returns.

14

Resolving disputes

Complaints

If you have a problem with an eBook you have purchased, please contact the seller in the first instance using the messaging function on BookStreet.io. If the seller does not resolve the issue within 14 days, or if you are unable to reach the seller, please contact BookStreet.io’s customer service team who will step in to assist and liaise with the seller on your behalf.

Alternative dispute resolution

Alternative dispute resolution is an optional process where an independent body considers the facts of a dispute and seeks to resolve it without you having to go to court. If you are not satisfied with the outcome of any complaint, you may submit a complaint to an alternative dispute resolution provider. You are not required to use alternative dispute resolution and, if you are not satisfied with the outcome, you can still go to court.

Going to court

These terms are governed by English law. You can bring claims against the seller in the English courts. If you live in Wales, Scotland or Northern Ireland, you can also bring claims in the courts of the country in which you live. The seller can bring claims against you in the courts of the country in which you live.

15

Other important terms

The seller may transfer the contract with you to another person or organisation, provided this does not adversely affect your rights under the contract. BookStreet.io will notify you if this happens.

You may not transfer your rights or obligations under the contract to another person without the seller’s written consent.

This contract is between you and the seller. No other person has any rights to enforce any of its terms, whether under the Contracts (Rights of Third Parties) Act 1999 or otherwise.

If any court or relevant authority finds that any part of these terms is invalid or unenforceable, the remaining terms will continue to apply.

Even if the seller delays in enforcing any right under the contract, this does not mean the seller has waived that right.
